What is the Difference between Manslaughter and Murders

First-degree murder second-degree murder and manslaughter are all different types of homicide.

Homicide basically means that one person takes the life of another. so if you go out and kill someone that's a homicide.

The different kinds of homicide depend on your level of intent. So let's start with First Degree Murder. 

First Degree Murder

First-degree murder is typically thought of as premeditated murder and that is exactly what it sounds (like premeditation), so You go out and You plan to kill someone. You execute that plan. that's premeditated murder.

For example:- You decide that you want to rob someone, You want to steal some money from somebody and you are going to kill them. 

In the process you just decide this in advance and I go out to the you know to find the per my target I take out my gun I shoot them I take their stuff and I leave that's premeditated murder I planned it I went I executed the plan.

Second Degree Murder

Second-Degree Murder is a little bit different second-degree murder is not as serious as first degree murder and the level of intent is what  ill-will spite hatred or evil intent 

These are the types of intent you would have in a second-degree murder so there's not necessarily a plan in this situation.

It's something oftentimes that has done out of incredible anger you might have a lot of times.

A domestic homicide could be this type of situation where you know you loved your wife very much but you couldn't take it anymore. The arguing in the fighting and you ended up killing her back. You know you you were there were some evil intent there. You were so angry at her, so upset with her that you just couldn't take it. So that would be your second degree murder and second of your murder is punishable also by up to a life sentence the death.

Penalty is not a possibility in a second-degree murder and they're the mandatory sentence on.

A second degree murder is typically if you have no criminal history typically around 20 years or so and that's based on a score sheet calculation that is done when you're convicted of a felony.

The manslaughter is a lot of times it's defined as not first or second degree murder but really what manslaughter is when a homicide has occurred as a result of your reckless behavior.
